1. Agreement
These Terms of Service are a contract between you and Weston Software LLC ("Stubs", "we", "us"). They govern your use of the Stubs iOS app and the Stubs service, together the "Service".
By creating an account or using the Service you agree to these Terms and to our Privacy Policy, which is part of this agreement. If you do not agree, do not use the Service.
There is no tolerance on Stubs for objectionable content or abusive behaviour. Section 6 says what that means, and section 7 says what we do about it.
2. Eligibility
You must be at least 13 years old to use Stubs. If the law where you live requires a higher age to consent to an online service, you must meet that age or have a parent or guardian provide any required consent and agree to these Terms for you.
We do not ask your age and we do not verify it. If we learn that an account belongs to someone below the minimum age, we delete it.
By using the Service you represent that you meet these requirements, that you have not previously been banned from the Service, and that you are not barred from using it under applicable law.
3. Your account
You may sign in using the methods Stubs makes available, which may include a third-party account or a verified phone number. You are responsible for the security of every sign-in method linked to your account and for everything done under your account. Remove a linked phone number before you lose control of it. Your @handle and display name are public. Do not impersonate anyone, do not take a handle designed to mislead, and do not share, sell, or transfer your account.
Tell us at security@joinstubs.com if you think your account has been compromised.
4. What the Service is
Stubs lets you keep a stub for each show you attended, score and rank it, write about it, add photos, follow other people, and browse artist, venue and trending pages.
Show, artist and venue information comes from third-party music data sources or from users. We do not guarantee that it is accurate, complete, or current. Stubs does not sell tickets, is not a ticketing service, carries no ticket-purchase links, is not affiliated with any artist, venue, promoter, or ticketing company, and does not verify that anyone actually attended any show they kept a stub for.
Stubs is free. There is nothing to buy in the app and no subscription.
5. Your content
You keep ownership of everything you post: your stubs, scores, rankings, reviews, photos, bio, and anything else you submit, together "Your Content". Your review of a show is public. It appears on that show's page to anyone who can see it, and other people can report it.
Licence you grant us. You grant Stubs a worldwide, non-exclusive, royalty-free, transferable, sublicensable licence to host, store, reproduce, adapt for display, for example by resizing and re-encoding an image, publish, publicly display, and distribute Your Content for the purpose of operating, providing, and promoting the Service. This licence exists so we can run the app: show your review on a show's page, put your photo in a feed, count your score into a community average.
The licence ends when you delete Your Content or your account, except that it may persist in backups for the period in the Privacy Policy, copies other people lawfully saved or shared are outside our control, and aggregate figures derived from Your Content that no longer identify you may continue to be used.
We do not claim ownership of Your Content, we do not sell it, and we do not use it to train machine-learning models.
Your responsibility. You represent that you own or have the rights to Your Content, that posting it does not infringe anyone's rights, including copyright, privacy, and publicity rights, and that it complies with section 6.
Other people's content. Content on Stubs comes from other people. We do not endorse it and we are not responsible for it. Reviews and scores are personal opinion.
6. What you may not post or do
Do not post, upload, or transmit content, and do not use the Service, in any way that:
- is illegal, or promotes or facilitates illegal activity;
- harasses, bullies, threatens, stalks, defames, or incites violence against anyone;
- is hate speech, or attacks or demeans people on the basis of race, ethnicity, national origin, religion, disability, age, sex, gender identity, or sexual orientation;
- is sexually explicit, pornographic, or sexualises minors in any way;
- is gratuitously violent, graphic, or designed to shock;
- is spam, bulk or repetitive posting, engagement manipulation, advertising, or solicitation;
- impersonates a person, brand, artist, or venue, or misrepresents your affiliation;
- infringes anyone's copyright, trademark, privacy, publicity, or other rights, including posting show photographs you do not have the right to share;
- discloses another person's private information without their permission, including tagging someone as having attended a show in order to expose where they were;
- contains malware, or attempts to compromise, probe, overload, scrape, reverse-engineer, get around rate limits or access controls, or otherwise interfere with the Service or with other people's accounts;
- uses automated means to create accounts, post content, or extract data without our written permission;
- falsifies stubs at scale, or manipulates rankings, community averages, or trending.
7. Moderation, reporting, and enforcement
Automatic checks. Public photos and text may be checked automatically before they are published, and photos may also be checked on your device before they are sent. Content a check rejects is not published. Passing a check is not our approval of what you posted, and it does not stop us acting later.
Reporting. Anyone can report a review, a photo, a show, or another person from inside the app, choosing a reason, spam, nudity or sexual content, harassment, hate speech, violence or threats, self-harm or suicide, impersonation, or other, and optionally adding a comment. Reports are private. We do not tell the person who reported them.
Blocking. You can block another person. A block works both ways: neither of you sees the other's content, profile, or activity, neither can follow the other, and any follows between you are removed.
Human review, within 24 hours. Reports go to a person, not to a filter. Nothing is removed by a report on its own. We aim to review reports of objectionable content within 24 hours and to remove content that violates these Terms and remove the person who posted it. Because a person does the reviewing, an unusual case may take longer.
What we may do. We may, with or without notice and at our discretion, remove or restrict content, limit account features, suspend, or terminate an account we reasonably believe violates these Terms, and we may do it for a single serious violation. We have no obligation to monitor content proactively, though we may. We are not obliged to remove content that does not violate these Terms.
Appeals. If you think we removed your content or restricted your account in error, write to abuse@joinstubs.com and we will look at the decision again.
8. Deleting content and your account
You can delete your own stubs, reviews, and photos in the app at any time. Deleting a stub also deletes its review and its photos.
To delete your whole account, use You, then Settings, then Delete account in the app. You confirm twice, and the deletion happens immediately and permanently. It cannot be undone and the data cannot be restored. What goes and what stays is in the Privacy Policy. If you no longer have the app, write to privacy@joinstubs.com instead.
9. Our intellectual property
The Stubs name, logo, app design, and software are ours and are protected by intellectual property law. These Terms give you a limited, personal, non-exclusive, non-transferable, revocable licence to use the app for its intended purpose. You may not copy, modify, distribute, sell, lease, or make derivative works from the Service, or remove any proprietary notice.
10. Copyright complaints
If you believe content on Stubs infringes your copyright, send a notice to our copyright contact at legal@joinstubs.com including: identification of the work; identification of the material you say infringes it and where it is in the Service; your contact details; a statement that you believe in good faith that the use is not authorised; a statement, under penalty of perjury, that the information is accurate and that you are the owner or authorised to act for them; and your physical or electronic signature.
We respond to valid notices and may remove the material. If your content was removed and you believe it was a mistake, you may send a counter-notice to the same address.
Repeat infringers. We terminate, in appropriate circumstances, the accounts of people who repeatedly infringe copyright.
11. Third-party services
The Service uses third-party authentication, mapping, imagery, infrastructure, communications, analytics, and music-data services. Your use of a service you choose to invoke may also be subject to that service's terms and privacy policy. We are not responsible for third-party services or for the accuracy of the data they supply. Where a picture in the app carries a credit, the credit is in the app under Settings, About, Legal, Acknowledgements, Photo credits, and the sources are described at Where our pictures come from.
12. Text messaging
Subscribers opt in through the Stubs app to receive automated verification messages from Weston Software LLC, powered by AWS Notify. Information about Stubs is available at joinstubs.com. Message frequency may vary per user.
Text HELP for help. Text STOP to cancel. Message and data rates may apply for any messages sent to you from us and to us from you. Carriers are not liable for delayed or undelivered messages. If you have questions about your text plan or data plan, contact your wireless provider.
For questions about Stubs or its messages, write to support@joinstubs.com. For information about how we handle phone numbers and messaging consent, read the Privacy Policy.
13. Changes to the Service and these Terms
We may change, suspend, or discontinue any part of the Service at any time. We may update these Terms. If a change is material we will update the date at the top and give reasonable notice in the app or by other means before it takes effect. Using the Service after a change takes effect means you accept the revised Terms. If you do not accept them, stop using the Service and delete your account.
14. Termination
You may stop using the Service and delete your account at any time, as described in section 8. We may suspend or terminate your access as described in section 7, or if we discontinue the Service. On termination the licence in section 9 ends. Sections 5 as to the surviving licence, 12, 14, 15, 16, 17, 18, 19, and 20 survive.
15. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, secure, or error-free, that defects will be corrected, or that show, artist, or venue data is accurate or complete. Keep your own copies of anything that matters to you.
Some places do not allow the exclusion of certain warranties. Nothing in these Terms limits rights you have under mandatory consumer-protection law that cannot be waived.
16. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, STUBS AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR CONTENT, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, STATUTE, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE, WHICH FOR A FREE APP IS NOTHING, OR USD 100.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, or for fraud.
17. Indemnity
To the extent permitted by law, you agree to indemnify and hold harmless Stubs and its officers, employees, and agents from any third-party claim, damage, loss, liability, or expense, including reasonable legal fees, arising from Your Content, your unlawful use of the Service, or your breach of these Terms or of another person's rights.
18. Governing law and disputes
Talk to us first. If you have a dispute with us, write to legal@joinstubs.com and give us 30 days to resolve it before starting formal proceedings, unless applicable law permits you to proceed sooner or urgent relief is reasonably necessary. Most things are fixable that way, and it costs you nothing.
These Terms are governed by the laws of the State of Michigan, without regard to its conflict-of-laws rules. A dispute may be brought in any state or federal court that has jurisdiction.
If you are a consumer resident in the European Economic Area or the United Kingdom, this section does not take away the protection of the mandatory law of your country of residence or your right to bring proceedings in your local courts.
19. Apple
These Terms are between you and Stubs, not Apple. Apple has no obligation to provide maintenance or support for the app. Apple is not responsible for the app or its content and, to the extent permitted by law, has no warranty obligation for it. Apple is not responsible for addressing any claim you or a third party has about the app, including product-liability, regulatory-compliance, or consumer-protection claims, or for investigating or defending a claim that the app infringes intellectual property rights. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You represent that you are not in a country subject to a US Government embargo or designated as terrorist-supporting, and that you are not on any US Government list of prohibited or restricted parties. You must comply with any applicable third-party terms when using the app.
20. General
These Terms and the Privacy Policy are the entire agreement between you and us about the Service. If a provision is held unenforceable, the rest stays in effect and that provision is limited to the minimum extent necessary. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets. Nothing here creates a partnership, agency, or employment relationship.
